Terms of Service

By commissioning me, purchasing my characters, or owning characters I have designed, you agree to follow my Terms of Service (TOS). It is the responsibility of the client to read my TOS fully.A. Authorship1. My designs and artwork are my intellectual property. I retain the right to use the art I create to promote commissions as examples, to post them on my social media accounts, and to use them for other related purposes.2. Do not claim my design or art as your own. You own the rights to the character, but you are not the creator of the design or the original art.3. Do not crop out, erase, or otherwise obscure my signature or watermark.4. For my designs, I will create the initial Toyhou.se profile and transfer ownership to the new owner. If I am not the first user listed in the Ownership tab, reach out to me about the authenticity of the design.B. Payment1. I accept the following methods of payment: Paypal and Ko-fi.2. Do not bid on or claim a design if you do not have the funds.3. I do not accept payment plans or holds on amounts less than $50. Payment plans and hold durations must be conveyed in writing and must be adhered to. Typically, I require half of the amount in upfront payment.4. The character must be paid in full before the new owner is allowed to use the character.5. Payments toward completed designs are non-refundable. Any amount paid will be considered compensation for my time during which the character was being paid off. If I am charged back, I am allowed to resell the design and blacklist you.6. Payments toward commissions may be refunded at the commissioner's request if work has not been started.C. Transferring Ownership1. Do not sell a design for more than it was bought for without extra art. The added art must be commissioned form someone else or quality art by you. For example, "messy uncolored sketch = $30" is an unacceptable valuation.2. You must transfer the original Toyhou.se profile of the character. You are not allowed to make separate profiles for one design for any reason. Co-owning is allowed, but there must only be one profile.3. Trading my designs for designs of different value does not alter the value of either character. For example, trading Character A (worth $50) for Character B (worth $10) does not make Character A worth $10 or Character B worth $50.D. Design/Artwork Guidelines1. Credit me as the designer when using the design for the first time. You may do this by linking or mentioning any of my social media accounts.2. Do not heavily reference my designs for characters you intend to profit on. You may color pick or practice patterns based on my designs, but do not sell or trade those designs for personal gain.3. Minor changes in the design (color changes or small pattern adjustments) are allowed. You may edit my artwork; however, you must keep the original design's artwork on the Toyhou.se profile.4. My artwork and designs are prohibited from being used in NFT, AI, and crypto-related projects. I do not consent to any of my work being used in training AI in any capacity.E. Miscellaneous1. If you are rude to me in DMs or otherwise degrade my person, art, or name, I have the right to blacklist you and create an awareness post on social media.2. Users will receive one warning before being blacklisted.3. Blacklisted users are not allowed to own, purchase, or trade for my designs. Anyone caught knowingly helping a blacklisted user get one of my designs will receive a warning.If you violate any of the terms in my TOS, you may be blacklisted.
