Terms of Service

Hi! Thank you for your interest in commissioning LiliariDesigns. If your commission is accepted, you will be provided a copy of this Terms of Service (TOS) document to read thoroughly and acknowledge. The parties involved are LiliariDesigns (“the Artist”), and the commissioner (“the Customer”). This document serves as a supplement to the Commission Agreement.A. Authorship
1. The Artist retains the copyright to all designs and artwork they produce. The Customer has permission to share the commission publicly and display it for personal use. The Artist retains the right to use the art they create to promote commissions as examples, to post on social media accounts, and to use for other business-related purposes.
1a. The Customer may request that the commission not be posted publicly. This must be requested prior to the final commission is delivered. This may result in a higher price as it ultimately hurts the Artist’s ability to advertise their work.
1b. The Customer may request that the commission be posted only after a specified date or event passes based on their intended use of the commission. Such occasions include but are not limited to: birthday gifts, anniversary gifts, usage for an event, etc.
2. The Customer must not claim the Artist’s designs or artwork as their own. Please credit the Artist when posting the finished commission online for the first time or listing merchandise that uses the Artist’s designs and/or artwork by linking back to one or more of the Artist’s social media accounts.

2b. Credits for multiple posts on the same platform are appreciated but not required. For example, if the Customer posts the commission three (3) times on Instagram, credit to the Artist is only required on the first post. However, if the Customer posts one (1) time each on Facebook, Instagram, and Twitter, credit is required on all three (3) posts.
3. Commercial use rights can be purchased for an additional fee of 50%-100% of the commission’s total price. Commercial use rights allow the Customer to use the commission for promotion, merchandise, and other for-profit purposes. The fee varies commission-to-commission and will be agreed upon in the Commission Agreement. Purchasing commercial use rights does not void sections A1 and A2 of the Artist’s TOS.
3a. Credits must be clearly visible in merchandise listings and in the description when digital products such as emotes, overlays, and other assets are used.
4. The Artist does not claim copyright over the content of artwork derived from existing intellectual properties (IPs) including but not limited to: branding, character designs, and names. The Artist only claims copyright over the artwork they produce.
4a. If the Customer would like a commission based on an existing IP, the Customer understands that the Artist will produce work inspired by the IP and will not use assets created by the owners of the IP.
5. The Customer is not allowed to use the commission or any process images at any point for generative AI (AI “art”). If the Customer is found uploading the Artist’s work into generative AI programs, the commission will be immediately canceled with no refund.
B. Payment
1. The Artist accepts the following methods of payment: Zelle, Venmo, Paypal, and Ko-fi. The Customer must indicate a preferred method of payment before the Artist provides an invoice to pay. The Artist will always confirm the payment method and amount at the time of payment and at the time of receipt.
2. The Artist does not accept payment plans under $100. Payment plans must be conveyed in writing and must be adhered to unless a delay is communicated.
2a. Payment plans require a non-refundable down payment of approximately 10% of the total commission cost. This down payment goes toward the total amount owed for the commission.
2b. Payment plan duration and payment dates must be specified and agreed upon prior to a commission’s acceptance.
3. The commission must be paid in full before any deliverables are sent to the Customer.
4. Payments cannot be refunded once the commission has been completed. A partial refund may be issued before the commission is completed based on the degree of completion if the Artist is unable to complete the commission.
C. Process
1. The Customer must provide a description of the commission concept. This includes but is not limited to: written descriptions, reference images, photo bashing, and sketches. A commission form is provided on Page 2 of the Commission Agreement if needed.
1a. Quality reference images make a huge difference in the final commission. It also helps to have multiple reference images to best convey the details of the commission concept.
1b. The Artist does not accept AI generated reference images. Rare exceptions may be made, but the Artist does not support the use of generative AI in any step of the creative process.
2. Once the commission concept has been submitted, the Artist will create a Commission Agreement with pricing, deliverables, and completion date.
3. Once the Commission Agreement has been signed by both parties, payment (either partial or full) must be provided to the Artist before any work can begin.
4. All process images will be watermarked with the Artist’s logo to prevent theft. These watermarks will not obstruct the view of the artwork so much that the Customer will not be able to determine approval.
5. The first phase in the process is the ideation/sketch phase. Multiple concepts will be provided to the Customer for feedback. The Customer must approve a concept to move forward with.
6. The Customer-approved concept then moves to the second phase: the color and refinement phase. Updates will be provided as the process allows. At this phase, the Customer may request up to one (1) revision at no additional cost. Any further revision(s) will incur an additional cost per revision. The Customer must approve of the colored and refined concept before moving to the final phase.
7. The final phase in the process is adding finishing details. At this phase the Customer may request up to one (1) revision at no additional cost. Any further revision(s) will incur an additional cost per revision. The Customer must approve the final concept.
8. Once the final concept is approved, the commission must be paid in full before any deliverables are sent to the Customer. The deliverables are detailed in the Commission Agreement.
D. Communication
1. Due to the number of Customer approvals required, the Artist asks that the Customer responds to any updates requiring approval within 48 hours. This allows the Artist to complete the commission by the agreed completion date.
1a. The Artist is not responsible for delays caused by the Customer. If the Artist does not receive a response within 48 hours, the Artist is allowed to push the completion date forward by double the time it takes to get a response from the Customer, rounded up to the next full day.
2. Communication may be conducted via any form of written digital communication including but not limited to: direct messages and emails.
3. Any delays in payment from the Customer or commission completion by the Artist must be communicated to the other party in a timely manner with a reason and an updated date of payment or commission completion.
E. Deliverables
1. All deliverables will be delivered on or before the completion date specified in the Commission Agreement.
1a. In the case of unforeseen circumstances, the Customer will be notified of any delays within 72 hours of the completion date or as soon as a delay is caused. The Customer will be reimbursed 10% of the price if the commission is not delivered on time and reimbursed in full if the commission is not completed within 2 weeks of the promised completion date. In both cases, the Customer will still receive the deliverables that have been completed at the time in addition to the reimbursement. This section exists solely for extreme circumstances as artwork is typically delivered on time.
2. Digital files will be delivered via email. The Customer must reply to the email containing the deliverables with a confirmation of receipt.
2a. The Artist does not guarantee that any digital files will be retained more than 1 month after delivery. The Customer must ensure that the files are downloaded and stored securely.
3. Physical items will be delivered via tracked USPS shipping.
3a. Shipping costs are the responsibility of the Customer. Shipping cost includes postage (based on weight), insurance, and packaging. It is highly encouraged to purchase additional insurance if the commission exceeds the included insurance value.
3b. The Customer may choose the type of shipping (Ground Advantage, Priority, etc) at their own expense. The Artist will provide estimates for different types of shipping prior to this decision.
E. Miscellaneous
1. The Artist reserves the right to refuse a Customer for any reason.
2. The Customer may choose to stop working with the Artist at any point in the commission process; however, if any work is started, a full refund is not possible.
3. It is the responsibility of the Customer to read the Artist’s TOS fully before acknowledging.
